1. Services offered
1.1. Carolyn Shurey provides guided forest therapy, yoga and Meditation in nature, online and in private spaces. Forest Therapy comprises one or more of a slow walk, gentle physical, creative or sensory activities. Yoga and Meditation sessions include guided physical postures, breath practices and meditation. All sessions are specifically reviewed, assessed and tailored to the guiding principles of the selected practice and are in line with either the International Core Curriculum for Forest Therapy or Yoga Australia guidelines.
1.2. Services may be provided individually or within private or public groups as available, and tailored to meet client goals. Participants are advised to follow guide instructions within their own capability, which may mean making personal adjustments during the session.
1.3 Services are delivered by a qualified and certified Forest Therapy Guide and Yoga Teacher. Certified by the International Nature and Forest Therapy Alliance (INFTA) and in line with Yoga Australia’s guidelines (300 hours of training with a recognised provider).
1.4 Carolyn Shurey can provide session to NDIS clients who are plan managed or self-managed.

2. Booking of services
2.1 All sessions with Carolyn Shurey are booked online, either via ticketing system or email.
2.2 Bookings are valid after completion of booking forms, and the confirmation email received when paying via the booking page or Carolyn’s email.
2.3 Individuals making a group booking are presumed to be acting with the approval of all other group members to act on their behalf, and all group members have reviewed the required documents.
2.4 We reserve the right to refuse to accept a booking based on the information revealed to us.
3. Inclusion and changes
3.1 Session inclusions are outlined on the offerings and on the booking page.
3.2 We reserve the right to make amendments to sessions to ensure participant safety and support needs. As some sessions are conducted outdoors, factors including but not limited to, weather, walking tracks and area access may change, requiring amendments to sessions without prior notice.
4. Cancellations and Changes to Booking Policy
4.1 Cancellations and changes to booking date/session times made by a participant/client may be subject to fees. Booking fees are non-refundable.
4.2 Changes to booking dates or session times can be made more than 48 hours before the start time of the Service. Change requests are subject to similar service availability and price changes.
4.3 Cancelling a booking less than 24 hours before the start time of the Service may be subject to a Cancellation Fee. This Short Notice Cancellation fee is the full payment of the scheduled fee.
4.4 Bookings cancelled less than 48 hours before the start time of the session, late arrivals and no shows are non-refundable and non-transferable, and require full payment of the scheduled service fee.
4.5 There is no charge if the session is postponed or cancelled by Carolyn Shurey (e.g., due to extreme weather, guide illness). Refund of 100% of payment (excluding booking fee).
4.6 Notification of cancellations or changes to booking date requests are to be made via email to Caroshurey@gmail.com
5 Your Responsibility
5.1 Prior to booking, it is your responsibility to complete a new client form if participating in a Yoga Class and read the description of services if participating in a Forest Therapy session. Choose a walk or event within your ability (and anyone that may accompany you such as a carer or support worker, or other family members on family-friendly sessions).
5.2 Prior to booking or signing the Service Agreement, read these Terms of Conditions provided thoroughly, and advise us of any relevant health or medical conditions, personal access requirements or special dietary requirements (relevant only for Forest Therapy sessions 2 hours or longer) at the time of booking.
5.3 For a Forest Therapy session, it is your responsibility to bring water, wear suitable clothing, sun protection and footwear for being outdoors. For an online Yoga class, it is Your responsibility to provide a safe space to practice Yoga and practice to you ability level using props as recommended by the yoga teacher.
5.4 For the session, you are responsible for your own conduct (and that of anyone aged under 18 years in your care that accompany you for family-friendly sessions) during the session, including following the directions and decisions of the guide.
5.5 You are responsible for anyone aged under 18 years in your care that accompanies you for family-friendly sessions.
5.6 You agree to indemnify Carolyn Shurey against any liabilities you may incur.
6 Assumption of Risk
6.1 You acknowledge that Forest Therapy sessions conducted by Carolyn Shurey are in natural environments and carry risks greater than normal, including but not limited to weather conditions, track surfaces, trip hazards and potential remoteness from medical assistance.
6.2 You acknowledge that access to or within locations may be closed at times due to, but not limited to weather, alerts or maintenance, and locations may need to change, or activities may vary.
7 Disclaimer, Release and Waiver of Liability
7.1 You agree that participation in the Services of Carolyn Shurey is not medical treatment and will not necessarily result in a medical benefit to you.
7.2 You agree to not make any claim or seek any compensation from Carolyn Shurey, her employees and representatives for any cost, liability, loss, injury or damage incurred or suffered by you as a result of your participation in walks, yoga sessions or events.
7.3 You hereby agree to release, indemnify, and discharge Carolyn Shurey, on behalf of yourself, your spouse, your children, your parents, your heirs, assigns, personal representative and estate as follows:
7.4 You acknowledge that outdoor Forest Therapy activities in natural areas entail unknown and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to yourself, to property, or to third parties. You understand that such risks cannot be eliminated without jeopardising the essential qualities of the activity. The risks include: slipping, tripping and falling; falling objects; water hazards; exhaustion; exposure to temperature and weather extremes which could cause hypothermia, hyperthermia (heat related illnesses), heat exhaustion, sunburn, dehydration; and exposure to potentially dangerous wild animals, insect bites, and hazardous plant life; accidents or illness can occur in remote places without medical facilities and emergency treatment or other services rendered; consumption of food or drink; equipment failure; improper lifting or carrying; your own physical condition, and the physical exertion associated with this activity.
7.5 You acknowledge that Carolyn Shurey has complex, difficult roles to perform and while they seek safety, they are not infallible. They might be unaware of a participant’s fitness or abilities. They might misjudge the weather or other environmental conditions. They may give incomplete warnings or instructions, incorrect information.
7.6 You expressly agree and promise to accept and assume all of the risks existing in this activity. Your participation in this activity is purely voluntary, and you elect to participate in spite of the risks.
7.7 You hereby voluntarily release, forever discharge and agree to indemnify and hold harmless Carolyn Shurey, from any and all claims, demands, or causes of action, which are in any way connected with your participation in this activity or your use of Carolyn Shurey equipment or facilities, including any such claims which allege negligent acts or omissions of Carolyn Shurey or the guide.
7.8 Should Carolyn Shurey, the guide, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, you agree to indemnify and hold them harmless for all such fees and costs.
7.9 You certify that you have adequate insurance to cover any injury or damage you may cause or suffer while participating, or else agree to bear the costs of such injury or damage yourself, including but not limited to access to remote medical or evacuation services. You further certify that you are willing to assume the risk of any medical or physical condition you may have.
7.10 In the event that you file a lawsuit against Carolyn Shurey, you agree to do so solely in the Melbourne Jurisdiction. You further agree that the substantive law of the State of Victoria shall apply in that action without regard to the conflict of law rules of that state. You agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.
7.11 You acknowledge that if anyone is hurt or property is damaged during your participation in this activity, you may be found by a court of law to have waived your right to maintain a lawsuit against Carolyn Shurey, on the basis of any claim from which you have released them herein.
7.12 You acknowledge that you have had sufficient opportunity to read this entire document. You have read and understood it, and you agree to be bound by its terms.
7.13 You agree that Carolyn Shurey, the guide or anyone acting on their behalf may take photographs or videos of you and the group on this walk and use these photographs in promotional materials (e.g., social media, website, printed flyers, etc.). If not, you will inform the guide prior to the start of the walk.
8 Payment
8.1 All prices are in Australian dollars (AUD) and payment may only be made in Australian dollars unless otherwise specified.
9 Complaints
9.1 If you have a difficulty or complaint during your event, please immediately raise it with your guide. We will endeavour to address any issue raised so you can enjoy your event.
9.2 If the problem cannot be resolved, contact Carolyn Shurey immediately by phone or email.
10 Termination
10.1 Carolyn Shurey reserves the right to terminate access, refuse service, and/or terminate accounts at its discretion and at any time without notice.
11 Disclaimer
11.1 The information contained within this website is provided by Carolyn Shurey in good faith that the information is accurate, current and is represented in accordance with Australian law.
11.2 Carolyn Shurey makes no representations or warranties of any kind, expressed or implied, as to the operation of the website or the information, content and materials, including the currency, accuracy or completeness, of any content or any information provided by third parties, on or through the website.
11.3 Carolyn Shurey will not be liable for any damages of any kind arising from the use of this website, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.
11.4 Carolyn Shurey does not guarantee that your access to the website or the functions contained within will be uninterrupted or error-free, that any errors will be corrected or that the website or the server is free of viruses, malicious computer code transmitted on or through the website or other harmful components.
12 Changes to the Terms and Conditions
12.1 Changes to the Terms and Conditions outlined can be made at the discretion of Carolyn Shurey. Any changes will apply for services after the date and time of the change.
